These terms and conditions describe what you are legally entitled to expect from us when you purchase travel, visa and related services through us, in addition to your obligations as a customer.
The terms “we”, “us” and “our” refer to Sky Wand Travels. The term “you” and “your” refers to the customer visiting our website, booking a reservation through us, using our visa services, or any other person to whom a booking is added or transferred to.
Sky Wand Travels acts as agent for visa and travel services that are fulfilled and supplied by third parties (for example: embassies and consulates, air carriage and ground transportation, hotel accommodation, meals, tours, cruises).
We sell a variety of visa and travel related products from different suppliers and service providers (“Suppliers”). You need to be aware that each Supplier has its own terms and condition that are applicable to your particular arrangements and are in addition to our terms and conditions.
Please take time to read carefully the following terms and conditions. It is your responsibility to ensure that you have read and understood the terms associated with your contract before placing any bookings.
Booking visa and / or travel with Sky Wand Travels constitutes your agreement to the terms and conditions below.
1. Bookings
All communications by Sky Wand Travels in relation to your visa/ travel booking will be sent to the address that you provide to us when you finalize your booking.
All bookings must be made through an authorized representative of Sky Wand Travels.
At the time of booking, a booking form must be completed and submitted together with the applicable visa fees or travel deposit discussed with your Sky Wand Travels sales representative, or as set out in the booking form.
No booking shall be confirmed until Sky Wand Travels issues written confirmation. Sky Wand Travels reserves the right to refuse a booking without reason and shall in such event return any visa fee and / or deposit received.
Your visa fees must be paid in full before Sky Wand Travels provides you with your visa, or as otherwise agreed in writing with your Sky Wand Travels sales representative. Your travel fees must be paid in full at least 30 days before the departure date. If you book within 30 days of your departure date payment must be made in full at the time of booking.
All special requests, such as special assistance or dietary requirements, should be noted clearly on the booking form.
If payment is not received by the due date, Sky Wand Travels reserves the right to cancel the relevant appointment and/ or booking in accordance with the cancellation fees below.
The person who signs the booking form guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure Sky Wand Travels receives payment in full by the due date and no reminders will be sent.
2. Pricing and changes
Sky Wand Travels reserves the right to notify you of any increase in price before accepting your booking.
After booking, the price of your visa/ flights/ holiday is subject to surcharges in certain circumstances, such as fees, fuel surcharges, taxes, and fluctuation in foreign exchange markets or any combination thereof. By accepting these terms, you agree to pay Sky Wand Travels for such surcharges.
If a surcharge increases the total price shown on your original confirmation price by 10% or more, you may cancel your booking within 5 days of the date of the revised price, and obtain a full refund for the relevant services, less the amount for services already utilized and administrative fees.
3. Cancellation and Changes by Sky Wand Travels
Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply. Please note that all reservation changes are subject to availability.
Changes to name details are not allowed by many airlines and other suppliers. While we will endeavor make such a change if necessary, please bear in mind that most airlines and Suppliers treat a name change as a cancellation, to which their standard conditions and charges apply.
Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as booked, please contact us and the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges, and/or your whole flight itinerary being cancelled, and/or your ticket being rendered void.
Occasionally it may be deemed necessary for us to make changes to your visa application or travel plan and Sky Wand Travels reserves the right to do so at any time. We will notify you of any changes at the earliest possible opportunity. If a major change to your visa application or travel plan is necessary, providing it does not arise from circumstances beyond Sky Wand Travels control, you may choose
(i) to accept the change of arrangements
(ii) to purchase another service from us, or
(iii) to cancel the relevant service. Compensation may be payable in cases of major change as detailed below. Major changes include cancellation, changes to your airport, delays in departure or return by more than 12 hours and accommodation changes to an inferior standard of accommodation.
No compensation will be payable for minor changes. Minor changes include minimal changes to an appointment or visa processing time, departure and arrival times, changes to the type of aircraft used, and restaurant and accommodation changes to a comparable or superior standard.
Compensation will not be paid for changes or cancellations caused by acts of God (Force Majeure), war, threat of war, riot, civil strike, industrial dispute, terrorist activity, natural or man-made disaster, fire, technical problems to transport, closure or congestion of airports, strikes or other industrial action, adverse weather conditions or any other event beyond Sky Wand Travels reasonable control. It is essential that you take out adequate travel insurance. Please speak with your sales representative about travel insurance.
Sky Wand Travels has the right to refuse you or any person as a member of your party any of its services where, in Sky Wand Travels reasonable opinion, such person could endanger the health, safety and enjoyment of others. In such event, Sky Wand Travels sole liability and the client’s sole remedy will be limited to a refund of any monies paid, less the amount for services already utilized and administrative fees.
If payment is not received by the due date, Sky Wand Travels reserves the right to cancel the relevant appointment and/ or booking in accordance with the cancellation fees below.
4. Cancellation charges
You may cancel your visa or travel service at any time provided that you notify Sky Wand Travels in writing. The following charges will be levied on any cancellation:
· 30 days or more: 25% of the total cost;
· 15 – 29 days: 50% of the total cost;
· 1 – 14 days: 100% of the total cost.
5. Our Responsibilities
While Sky Wand Travels has exercised care in selecting Suppliers, such as embassies/ consulates, aircraft, accommodation, restaurants, Sky Wand Travels does not own, manage or represent such Suppliers and will not be responsible for the services delivered by them.
Subject to its statutory obligations, Sky Wand Travels is not responsible if you or any member of your party suffer death, illness or personal injury during the services that you book through us. Sky Wand Travels will however, offer reasonable general assistance.
Sky Wand Travels regrets that no refund will be made on unused tickets (including travel, sporting event or other types of ticket) unless a refund can be obtained from the relevant carrier or Supplier.
6. Your Responsibilities
You are responsible for arranging your own travel insurance, though an appropriate policy can be incorporated into your travel package. Details of all insurance policies held by each member of your party must be provided on the booking form. No booking forms can be accepted without sufficient proof that personal policies have been arranged. Please ensure that your insurance cover applies to the specific activities you are booking as set out in the booking form and confirmation. Please talk to your Sky Wand Travels sales representative if you have any questions.
Each member of the party must have a valid passport, visas and all necessary documentation for the countries they are visiting. Sky Wand Travels accepts no responsibility for any delay or expense should your documents not be in order.
You are responsible for checking-in for flights at the correct time and for presenting yourself to take all pre-booked components of your holiday. Sky Wand Travels cannot accept responsibility for you missing flights as a result of late check-ins, and no credit or refunds will be given if you fail to take any component of your visa and / or travel plan. No credit of refunds will be given by Sky Wand Travels for lost, mislaid or destroyed travel documents.
By booking services with Sky Wand Travels you undertake to behave in an orderly manner and not to disrupt the enjoyment of others nor do anything to bring the reputation of Sky Wand Travels into disrepute. If you breach this clause your visa and / or travel booking will be terminated with immediate effect and treated as a cancellation by you. Accordingly, Sky Wand Travels be entitled to charge the above cancellation fees.
It is your responsibility to disclose any pre-existing medical conditions that you and / or members of your party may have.
All equipment and personal effects shall be all times and in all circumstances at the owner’s risk. Sky Wand Travels does not accept responsibility for any loss or damage or delay to your luggage or effects unless directly caused by the negligence of one of our representatives.
6. Smoking
Sky Wand Travels forbids smoking in any vehicle operated or hired by Sky Wand Travels. Frequent stops can be arranged for those who desire to smoke. All accommodation will be reserved with non-smoking rooms, unless you specifically require a smoking room. Confirmation is dependent on hotel availability.
7. Waiver and vaccinations
You should be aware that aspects of your travel plan may include risk, for example if you have booked a para-gliding activity. You should be prepared to sign a ‘Waiver of Responsibility’ form before you begin such an activity and exercise judgment and care at all times to ensure your own safety and that of fellow participants/ travelers.
Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged for your itinerary all necessary vaccinations as well as any other health and safety measures.
8. Disclaimer
Sky Wand Travels has made all reasonable efforts to check the accuracy of the information contained in our website. Sky Wand Travels does however accept any liability for any errors or omissions that may appear in this site.
You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.
Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any “robot”, “spider” or other automated or manual device or program, (b) deep link to any portion of our website, or (c) “frame” or incorporate any portion of our website into any other website.
9. Complaints
If you have a problem during your purchased service, please immediately inform Sky Wand Travels as well as the relevant airline, hotel, local suppliers so that they/ we can endeavor to put things right.
Sky Wand Travels will not be responsible for the non-performance of an itinerary through causes beyond our control or when we are not notified of a problem at the point where remedial action can be taken. In the unlikely event that a complaint cannot be resolved at the time, you should write to Sky Wand Travels within 28 days of returning home and include your original booking reference number and details of your complaint. If you fail to take any of these steps you will hinder Sky Wand Travels ability to put any problem right and/or investigate it fully, and any right you have to receive compensation may be affected.
Data Protection Act
It may be necessary for Sky Wand Travels to ask you for certain personal information, including dietary requirements, medical or religious information. This information will be kept confidential by Sky Wand Travels. You consent to such information being shared with Suppliers to perform the services that you have contracted for.
Limitation of liability
Sky Wand Travels total liability for any and all claims, for an event or services of connected events, is limited to 100% of the fees paid by you under this agreement.
Neither party shall be liable to the other party for any remote, unforeseeable, contingent, indirect or inconsequential losses.
Notices
For the purpose of this clause, Business Day is defined as a day (other than a Saturday, Sunday or public holiday) when banks in the country where you are based are open for business.
Any notice or other communication given to a party under or in connection with this contract shall be in writing, addressed to the receiving party at its registered office or such other address as the receiving party may have specified in writing, and shall be delivered personally, or sent by pre-paid first-class post or other next working day delivery service, commercial courier, or email.
A notice or other communication shall be deemed to have been received: if delivered personally, when left at the address referred to above; if sent by pre-paid first-class post or other next working day delivery service, at 9.00 am on the second Business Day after posting; if delivered by commercial courier, on the date and at the time that the courier's delivery receipt is signed; or, if sent by email, one Business Day after transmission.
The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.
General
All information given by SkyWand whether in writing or orally is to the best of SkyWand’s knowledge and believed correct at the time given and is given in good faith. In the event of a conflict of terms in a booking form and these terms and conditions, the relevant booking form shall prevail.
Any dispute that may arise will be governed by the law of Dubai, United Arab Emirates and both parties shall submit to the jurisdiction of the courts of Dubai, United Arab Emirates.
